PROBATE ASSISTANCE

Probate is the legal process of settling a person’s estate after death. During this process, assets are identified and inventoried, valid debts and taxes are paid, and the remaining property is distributed to heirs or beneficiaries according to the will—or, if no will exists, in accordance with state law. The individual responsible for managing this

process is known as the personal representative (sometimes referred to as an executor). If you have a valid will, this person is typically named within the document. If not, the court will appoint someone to serve in that role, which can sometimes lead to delays or added complexity.

A guardian is appointed to make personal decisions on behalf of an individual, including matters related to healthcare, living arrangements, and overall well-being. A conservator, on the other hand, is responsible for managing financial affairs—such as paying bills, protecting assets, and making decisions regarding property and income.

Both roles are subject to ongoing court oversight to ensure that decisions are made in the best interest of the protected person. While guardianship and conservatorship can be necessary in certain circumstances, they can also be time-intensive, public, and restrictive.
